These Terms and Conditions ("Terms") apply to the Montclare Holiday Fair website at holidayfair.montclarepa.org, run by the Montclare Children's School Parents Association ("the PA," "we," "us"). By using the site, joining the face-painting waitlist, buying raffle tickets, or ordering from the holiday shop, you agree to these Terms.
1. Face-painting waitlist and texts
If you join the waitlist and agree to receive text messages, you'll get a text when your child's turn is ready. Expect 1–2 messages on the day of the fair. Message and data rates may apply. We do not send marketing or promotional messages, and agreeing to texts is not a condition of taking part in any activity.
Texts are sent on our behalf by J&Z Foundation Inc. Reply STOP to any message to opt out, or HELP for help. The J&Z Foundation Terms also apply to these messages. Carriers are not liable for delayed or undelivered messages.
2. 50/50 raffle
Ordering on the site reserves tickets. Your tickets count only after you pay at the raffle table by card or cash, when ticket numbers are assigned. Half the pot goes to the winner and the other half supports Montclare Children's School. The winner is drawn at random from paid tickets at the fair and collects the prize at the raffle table. Ticket sales are final unless an order is voided by raffle staff.
3. Holiday shop
Items bought online are paid on Square's checkout page and picked up at the Holiday Marketplace at the fair; we don't ship. Bring your order code or give the name on the order at pickup. Quantities are limited. If we can't fill a paid order, we'll refund it. For other refund questions, email us.
4. Your responsibilities
You agree to give accurate information and to sign up only with a mobile number that you own or are authorized to use. You must be at least 18 years old to sign up or buy tickets, and you may sign up a child only if you are their parent or guardian. You agree not to misuse the site, for example by submitting false entries.
5. Event details
Waitlist positions, estimated times, and other fair details are approximate and may change. We may adjust schedules, pause or end an activity, or remove sign-ups, for example if a child is not present when called.
6. Disclaimer and liability
The site and text messages are provided "as is," without warranties of any kind. To the fullest extent permitted by law, the PA and its volunteers are not liable for any indirect or consequential damages, or for losses arising from delayed, missed, or undelivered messages or from your use of the site.
7. Privacy
How we handle your information is described in our Privacy Policy, which is part of these Terms.
8. Changes and governing law
We may update these Terms and will post the new version here with a new effective date. These Terms are governed by the laws of the State of New York.
